Terms of service
Overload! by Loony Collider
Welcome to Overload! These Terms of Service (“Terms”) are an agreement between you and LOONY COLLIDER (U) LTD (“Loony Collider”, “we”, “us”, “our”) about your use of the Overload! mobile game, its updates, and any related services (together, the “Game”).
By downloading, installing or playing the Game, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Game.
1. Who can play
You may use the Game if you are old enough to agree to these Terms where you live. If you are under that age, a parent or legal guardian must review and agree to these Terms for you, and is responsible for your use of the Game, including any purchases.
2. Your licence to play
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Game on devices you own or control, for your own non-commercial entertainment.
You may not:
- copy, sell, rent, sublicense or distribute the Game or any part of it;
- reverse engineer, decompile, modify or create derivative works of the Game, except where the law allows it;
- use cheats, hacks, bots, modified clients or any unauthorised software to change how the Game works or to gain an advantage;
- exploit bugs or errors (please report them to us instead);
- interfere with the Game, its servers, its ads or its purchases, or try to get around any security or technical limits;
- use the Game for anything unlawful.
3. Ownership
The Game and everything in it, including its code, graphics, vehicles, characters, music, sounds, text and trademarks, belong to Loony Collider or our licensors and are protected by copyright and other laws. These Terms don’t give you any ownership of them. Everything not expressly granted to you is reserved by us.
4. Virtual items and currency
The Game includes virtual items and currencies, such as coins, Licence Stamps, boosts, vehicles, upgrades and cosmetic items (“Virtual Items”). Some can be earned by playing, some by watching optional ads, and some can be bought with real money.
- Virtual Items have no real-world money value. They can’t be exchanged for cash, sold, traded or transferred, inside or outside the Game.
- When you get a Virtual Item, you receive a limited licence to use it in the Game. You don’t own it.
- We may change, rebalance or remove Virtual Items, their prices or how they work, for example to keep the Game fair and balanced. Where the law requires it, we’ll make sure this doesn’t unfairly take away something you paid for.
- Virtual Items may be lost if you delete the Game, delete your data, reset or lose your device, or if the Game ends (see section 10).
5. Purchases
- Purchases are made through the Apple App Store or Google Play and are subject to their terms and payment rules. We don’t receive or store your payment card details.
- Prices are shown in the Game before you buy. Taxes may apply depending on where you live.
- All purchases are final and non-refundable, except as required by law or by the store’s own refund policy. Refund requests are handled by Apple or Google; please contact them first.
- If you live in the European Union, the United Kingdom or another place with a similar right: by completing a purchase of digital content that’s delivered straight away, you agree to its immediate delivery and acknowledge that you lose your right to withdraw from (cancel) that purchase once delivery begins.
- If a purchase doesn’t arrive, use Restore purchases in Settings, or contact us and we’ll help.
- Parents: you can control or block in-app purchases in your device’s or store’s settings.
6. Ads
The Game is free to play and shows advertisements. Some ads are optional and give you a reward for watching them to the end. Others may appear between runs. Buying “No Ads” removes the ads between runs; optional reward ads stay available if you want them.
Ads are provided by third-party ad networks. Where the law requires it, we ask for your consent before using your data for personalised ads, and you can change your choice at any time with Withdraw consent in Settings. See our Privacy Policy for details.
7. Your data and progress
Your game progress is saved on your device. Our Privacy Policy explains what data we collect, how we use it, and your rights.
You can delete your game data at any time with Delete my account in Settings. This erases your progress, Virtual Items and settings on that device, and it can’t be undone. Purchases made with real money can be restored afterwards with Restore purchases where the store supports it.
8. Updates and changes to the Game
We may update the Game at any time, for example to fix bugs, add or change content, or meet new requirements. Some updates may be needed to keep playing. We may also add, change or remove features, events, offers or modes.
9. Availability
We work to keep the Game running smoothly, but we don’t promise that it will always be available, uninterrupted or free of errors. Features that need an internet connection (such as ads, purchases and downloaded game settings) may not work without one.
10. Ending your use
You can stop playing at any time by deleting the Game.
We may suspend or end your access to the Game, or to features of it, if you break these Terms, if we must for legal reasons, or if we stop offering the Game. If we stop offering the Game entirely, we’ll try to give reasonable notice where possible. Sections 3, 4, 11, 12, 13 and 15 continue to apply after your use ends.
11. Disclaimer
The Game is provided “as is” and “as available”. To the fullest extent the law allows, we make no promises or warranties of any kind, express or implied, including about merchantability, fitness for a particular purpose, or non-infringement.
Some places don’t allow these exclusions, so some of them may not apply to you. Nothing in these Terms affects your statutory rights as a consumer.
12. Limitation of liability
To the fullest extent the law allows, Loony Collider will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, Virtual Items, profits or goodwill, arising from your use of, or inability to use, the Game.
Our total liability to you for any claim about the Game is limited to the amount you paid us for the Game in the 12 months before the claim, or USD $10, whichever is greater.
Nothing in these Terms limits liability that can’t be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
13. Third-party services
The Game uses third-party services, such as the app stores, ad networks and analytics providers. Your use of them is also subject to their own terms and privacy policies, and we aren’t responsible for them.
14. Apple-specific terms
If you downloaded the Game from the Apple App Store:
- These Terms are between you and Loony Collider only, not Apple. Apple is not responsible for the Game or its content.
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for the Game.
- Apple is not responsible for addressing any claims by you or any third party about the Game, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
- Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the Game infringes their intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Governing law
These Terms are governed by the laws of the Republic of Uganda, without regard to its conflict-of-law rules. Any dispute will be handled by the courts of the Republic of Uganda, unless the law where you live gives you the right to bring it in your local courts. If you are a consumer, you keep the protections of the mandatory laws of the country where you live.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll change the “Last updated” date above, and for important changes we’ll let you know in the Game or on this page. If you keep playing after the changes take effect, you accept the updated Terms.
17. General
- If any part of these Terms is found unenforceable, the rest stays in effect.
- If we don’t enforce a part of these Terms straight away, we haven’t given up the right to enforce it later.
- You may not transfer your rights under these Terms. We may transfer ours, for example if the Game is sold.
- These Terms, together with our Privacy Policy, are the whole agreement between you and us about the Game.
